Johnny Depp’s $50 million defamation lawsuit against his ex-wife Amber Heard has taken another surprising turn. In explosive new testimony from the case, Heard is accused of having a “three way affair” with Elon Musk and Cara Delevingne.

According to the Daily Mail, the trio hooked up in late 2016 after Heard split from Depp. In a new deposition from Depp’s friend and former neighbor Josh Drew, he claims Heard, Musk, and Delevingne had their mé·nage à trois at Depp’s downtown LA penthouse.

The Pirates of the Caribbean star dragged Musk and actor James Franco into the case last year when he filed paperwork demanding that both the SpaceX CEO and Pineapple Express star turn over all messages, emails, and conversations they had with Heard around the time she and Depp split in May 2016.

Insiders say that Depp still “hasn’t ruled out” serving Delevingne with a subpoena so she can be deposed about any useful information she might have regarding the lawsuit.

“Cara could also be compelled to give evidence – by either party,” explained a source. “It’s definitely a possibility. Almost anything can happen in this case.”

Depp filed his lawsuit against Heard in March 2019 after she wrote a Washington Post op-ed claiming that she was a domestic violence survivor. Heard never mentioned Depp by name in her article, but he still sued Heard for defamation with claims that her “hoax” allegations sparked speculation that Depp was abusive.

The lawsuit argues that Heard’s column portraying herself as a survivor of domestic violence caused him to lose the role of Captain Jack Sparrow, which is a character that has made Depp millions over the years.

The accusations of a threesome between Heard, Musk, and Delevingne are from Drew, who was once married to Heard’s best friend, Raquel “Rocky” Pennington. Drew lived rent-free in one of the neighboring apartments that Depp owned, and he told attorney Benjamin Chew that Pennington told him Heard was having an affair with Delevingne.

“Did she ever tell you in words or substance while Amber was still married to Johnny Depp that the three of them, Amber Heard, Elon Musk and Carla Delevingne spent the night together?” Chew asks.

“Yes,” replies Drew. “To the specific date, I can’t say.”

Drew added that his understanding of the situation was that Musk, Heard, and Delevingne were having a “three way affair.”

Musk dated Heard on-and-off for several years, but the Tesla CEO claims that the relationship didn’t turn physical until after she split from Depp. However, Depp claims that Musk’s relationship with Heard started well before that.

Depp wants to know – according to his filing – what Heard told Musk about their big blowout fight that ended in Heard getting a restraining order against Depp when she accused him of throwing a phone at her and getting violent.

In response to the allegations that he had a three-way affair with Heard and Delevingne, Musk told Page Six: “Cara and I are friends, but we’ve never been intimate. She would confirm this.
Also, I wish to confirm again that Amber and I only started going out about a month after her divorce filing. I don’t think I was ever even in the vicinity of Amber during their marriage!”

Elon Musk added that he believes everyone involved in the lawsuit should just “bury the hatchet and move on” because life is too short for such extended negativity.

“Nobody is going to say, after it’s all over, that they wished the court battle had lasted longer,” said Musk.
