On the day that the New York courts opened back up after the COVID-19 lockdown, Mary-Kate Olsen officially filed for divorce from her husband, Olivier Sarkozy, after four-and-a-half years of marriage.

According to Page Six, the former child star filed for divorce in New York County Supreme Court on Monday, May 25. Last week, Chief Administrative Judge Lawrence Marks announced that starting on Memorial Day, the electronic filing system for New York City’s five boroughs would start accepting new lawsuits and divorce filings.

Olsen originally signed a petition to divorce Sarkozy on April 17, but because of the novel coronavirus pandemic the court wouldn’t accept her filing. During the court shutdown, they only accepted emergency divorce filings.

The 33-year-old fashion designer attempted to convince the court on May 13 that her divorce was an “essential matter” because the 50-year-old French banker had failed to renew the lease on their Gramercy apartment without telling her. However, a New York Supreme Court judge denied her request and told Olsen that she would have to wait until the courts opened up.

New York City attorney Bernard Post told People magazine that the judge denied Olsen’s request because it wasn’t a true emergency.

“Domestic violence is an emergency, perhaps refusing to provide health care is an emergency. I want to be divorced because I want to be divorced now is not an emergency,” explained Post.

Insiders say that Olsen and Sarkozy had several issues in their relationship that resulted in their split, but the biggest one was the fact they couldn’t agree on starting a family. An insider says that Sarkozy already has two grown children with his ex-wife, Charlotte Bernard, and he didn’t want more kids.

However, Olsen – who was originally on the same page as Sarkozy about children – has now made having a baby a priority.

“Olivier has two grown kids and doesn’t want more,” said the insider. “Mary-Kate thought he would budge on that and he hasn’t.”

Another issue that drove a wedge into the marriage was Sarkozy’s “party boy” lifestyle. The source explained that Sarkozy is a big spender who loves the high life, but Olsen prefers to be quiet and alone, while doing things that she likes.

Despite the problems she faced with filing for divorce, insiders say that Mary-Kate Olsen has nothing to worry about when it comes to her massive fortune from her career as a child actor, not to mention the two clothing brands – The Row and Elizabeth and James – that she runs with her sister, Ashley.

The insider says that Olsen has an “ironclad prenup,” even though she was worried about losing her personal property after being forced out of the Gramercy apartment.
