Mary-Kate Olsen's Emergency Affidavit For Divorce Denied By New York Judge, Says She Is 'Petrified' To Lose Her Home & Personal Property

During the COVID-19 pandemic, courts are closed in New York City – with the exception of handling “essential matters” – and apparently Mary-Kate Olsen’s divorce does not fall into that category. On Wednesday, Olsen filed an emergency affidavit because divorce applications are not being granted due to the pandemic, but a day later a judge denied her request.

According to People magazine, in the affidavit Olsen cited her fear of being forced out of her apartment by her estranged husband, Olivier Sarkozy. She claimed that Sarkozy terminated their lease for their New York City apartment without her knowledge, and she has some serious concerns about moving in the middle of a pandemic.

The fashion designer filed an application for a Summons and Complaint for divorce last month, but since the courts are shut down she filed her emergency affidavit this week asking the court to deem her divorce “an essential matter.”

The 33-year-old said in her claim that she was at risk of losing all her property in the apartment because she had no idea the lease wasn’t renewed. She says that Sarkozy is forcing her out by May 18 even though she never consented to terminating the lease.

“This application is an emergency because my husband expects me to move out of our home on Monday, May 18, 2020, in the middle of New York City being on pause due to COVID-19,” Olsen said in the affidavit. “I am petrified that my husband is trying to deprive me of the home that we have lived in and if he is successful, I will not only lose my home but I risk losing my personal property as well.”

The Full House alum added that she is “gravely concerned” that her husband will dissipate or dispose of her separate property belongings, as well as their marital property belongings that are located in the Gramercy Apartment.

Ashley Olsen’s twin sister said that it was impossible to move so quickly during a pandemic and she hasn’t even had the chance to find a new apartment. But, a New York Supreme Judge denied her request to make her divorce application an “essential matter,” according to court spokesman Lucian Chalfen.

At this point, it looks like Mary-Kate Olsen is going to have to wait until the courts reopen before she will get her divorce.
